Salmonella Egg Lawsuit Filed by Marler Clark

Marler Clark, a food safety law firm, has filed a third lawsuit against Quality Egg, also known as Wright County Egg. Wandro, Baer, and McCarthy are also listed on the suit. The lawsuit was filed in the Northern District Court of Iowa for a minor who became sick after eating contaminated eggs in a North Carolina restaurant.

Food safety attorneys with the firm are also seeking the right to inspect the facility for signs of food safety violations. Officials announced on August 26 that testing done at the Wright Country Egg factory, both in the factory environment and in the chicken feed, came up positive for strains of the bacteria that are directly linked to over 1,300 cases of Salmonella across the country.

The outbreak was first suspected in April, when health officials in North Carolina investigated a group of clustered Salmonella illnesses. 74 different illnesses were traced back to a restaurant in Durham. The plantiff in the lawsuit consumed a dessert made with a pasteurized egg white product produced by Wright County Egg in Iowa. Her case of Salmonella required a week of hospital care.

Over 330 million eggs were recalled by the company in August. Hillandale Farms, a fellow Iowa egg company, also recalled 170 million eggs. All together these contaminated eggs added up to create one of the biggest food recalls in the history of the United States. Illnesses caused by the Salmonella tainted food products have been reported in Colorado, Iowa, Wisconsin, North Carolina, South Dakota, Texas, California, and many other states.
